Booking Conditions

Please read these booking conditions carefully as they apply to all bookings accepted by The Private Company and Private Villas and Houses. The Private Company and Private Villas and Houses are not themselves a transport, tour event or accommodation provider.

They act only as an agent for those service providers. You should obtain and read the applicable service providers terms and conditions as they may limit or exclude liability in respect of death, personal injury, delay and loss or damage to baggage.


COMMUNICATIONS

All Agent communication must be with The Private Company and Private Villas and Houses. The Agent must not contact the owner or villa manager directly in regards to any and all booking related matters. Any attempts to contact villa owners without prior arrangement will result in immediate termination of representation rights.

 

III. Rates

a) All rates are quoted in USD and are not inclusive of tax or service charge. Rates are subject

to change. Tax on rates is generally 10%. The service charge is generally 5%. Both tax and

service charge are calculated on the gross price and vary from Villa to Villa please refer to your

invoice.

Tax and service charges are non commissionable.

b) Rates do not include gratuities, telephone or Internet charges, meals, or cars and drivers, or

any other service, unless stated otherwise

c) The Private Company and Private Villas and Houses will not offer published rates lower than those

given to Agents.

Agents may ask for discounts on specific inquiries. Such requests will be considered on a case-by-

case basis and the final decision is in the sole discretion of The Private Company and Private Villas

and Houses.

d) The Private Company and Private Villas and Houses will use their best efforts to give advance

notice of rate changes and will try to limit villa owners to no more than one adjustment to the

public rates per year (Note: We strive to schedule rate changes in July and January of each year).

 

Seasons

The seasons listed below is a general guide to all Villa and House properties refer to individual Villa and Houses for exact seasonality. Seasonality is also subject to change.

2011:

Easter week: April 22nd to April 28th inclusive

Chinese New Year: February 01 to February 06 inclusive

High: July 1 to July 31 inclusive

September 01 to September 15 inclusive

Easter Week (exact dates will be published in advance each year)

Chinese New Year (exact dates will be published in advance each year)

Peak: August 01 to August 31inclusive

December 20 to January 8 inclusive

Minimum Nights’ Stay Requirements

All Private Company and Private Villa and Houses villas enforce a Minimum Nights’ Stay Requirement. The general policy is stated below and should be used as a general guide only.

Low season: 2 nights

High season: 5 nights

Peak season: 7 nights


Payments & Cancellations

  • For ALL Agents: A deposit of 50% of the rental amount must be received by The Private

Company and Private Villas and Houses within five(5) working days after confirmation of reservation has been given. Full payment is required within five (5) days if the booking is made less than 45 days prior to arrival (or 60 days for Christmas/New Year bookings); if less than 5 days remain before the booking commences, the monies are due immediately.

  • For ALL Agents: Final payment is required 45 days prior to arrival (60 days for Christmas/NewYear bookings).
  • Payment to The Private Company and Private Villas and Houses can be made by either bank transfer(transfer fees to be borne by the Agent), credit card(fees will apply) or Money Direct
  • For last minute bookings (within 1 week or less prior to arrival), full payment must be received by The Private Company and Private Villas and houses prior to the clients arrival at the Villa
  • Deposits will be refunded in full less USD500.00 or 5% of the booking value(whichever isgreater), if the reservation is cancelled 61 days or more prior to arrival (91 days forChristmas/New Year bookings). In the event a reservation is cancelled less than 61 days prior to arrival (or 91 days for Christmas/New Year bookings) the deposit will be forfeited.
  • This cancellation policy is a general cancellation policy some villas have different conditions please ask for information in regarding the specif cancellation request.

The agent is responsible for clearly conveying and enforcing this provision.

  • Notice of cancellation must be received by The Private Company and Private Villas and Houses in writing.
  • Final payments are non-refundable.


  • Be aware that all clients at The Private Company and Private Villas and Houses villas must sign a waiver of liability and a credit card authorization form upon their arrival/check-in to the villa which will allow the owner to charge the card for damages and any additional charges that the clients incur whilst at the villa. If for any reason that credit card transaction is refused by the bank and/or damages incurred by the client exceed that amount, the agent will be held responsible for those damages. This could result in the confiscation of future deposits for other clients. It should be noted that clients refusing to sign this waiver form is considered as a cancellation.

 

Changes to Bookings

A US$100.00 administration fee will apply to each change after a booking has been confirmed.

Changes cannot necessarily be accommodated in all cases.


Check In and Check Out Times

  • Clients may check into a villa after 2pm.
  • The mandatory check out time is 11am.
  • In cases where there is no other booking for the same day, The Villa owner may extend the check-out time until 3pm.
  • Late check-out prior to 6pm will incur a half-night rate and is subject to availability
  • Late check-out past 6pm incurs a full night rate.

 

 

 

 

 

 

XI. Events & Parties

  • All of The Private Companies and Private Villas and Houses villas have rules governing their usage for events and parties (defined by the number of people attending) and for anything deemed an event, a surcharge (the ‘Function Fee’ is applicable (plus a mandatory donation to the local community, a ‘Banjar fee’). Normal bookings are for vacation purposes and special permission must be obtained for functions where the number of people in attendance exceeds 150% of the capacity of the villa. Also, clients should be aware that these are private villas located in residential neighbourhoods and, as such, not all functions or events can necessarily be accommodated. Much depends on the vagaries of the Banjar (the neighbourhood’s residents’ association). Guests must respect and abide by villa and Banjar regulations (i.e. curfews and noise limits).


  • Weddings and other events held at villas are becoming increasingly popular. Please beaware that The Private Company and Private Villas and Houses Villas will not accept a booking involving a function without prior confirmation that a professional function coordinator has been employed by the Clients. We only recommend Cher Ange wedding and events www.cherange.com 
  • Attempting to hold a function without prior approval of the management and/or without aPrivate Company and Private Villas and Houses approved coordinator will be considered a cancellation of the booking.
  • Events can not be held on guest check in or check out days (as they often involve set-up and extensive clean ups after the event).
  • If your clients are planning to hold an event such as a wedding or any large congregation of people at the villa, it would be best to bring this to the Private Company’s attention as soon as possible.

Regarding extra charges, please refer to “Function Fee.”


Function Fees

With regard to holding a Function at a private villa, your client will require a professional coordinator

who is approved by The Private Company. The Private Company only reccomends Chearange wedding and events see  www.cherange.com 

The coordinator is responsible for organizing all aspects of functions (e.g. music, catering, seating arrangements, transportation for guests, additional staff, tableware and decorations etc). If your client is planning to hold an event such as a wedding or any

large congregation of people at a villa, please inform The Private Companyas soon as possible.

  • A security deposit will be payable at time of check-in and refundable if no loss/damage is caused. If any damages are caused, the repair / replacement cost will be the responsibility of the client (amount of security deposit – please refer to each villa event guidelines)
  • The Function Fee includes Agent’s Commission. (Similar to villa nights, Function Fees are subject to 10% TAX and a 5% Service Charge, which is non-commissionable!)
  • An additional Banjar Fee will apply and is not commissionable. This will be quoted at time of booking and should be paid with the balance payment to avoid extra invoicing and bank charges.


The Private Company and Private Villas and Houses Services & Facilities

  • Suggested Menu’s can be provided prior to client arriving at the Villa so that arrangements for food , snacks and maels can be made in advance. The client will reimburse the villa staff for these provisions on arrival.
  • Drinks can also be pre ordered and massage times booked again these will be paid by the client direct to the villa.
  • All Private Company and Private Villas and houses villas  in most instances will provide flowers, welcome drinks, and refreshing towels upon check-in.

 

 

 

 

 

 

 

Transportation

Being private villas, the majority of The Private Company’s villas are difficult (if not impossible) to find by taxi, lacking

proper road addresses and signage.

Very few people are aware but in Bali property owners have the ability to choose their own house

street number. This results in chaotic situations of roads, streets and lanes with non-sequential and

illogical numbering systems. Unless they are very well known destinations (such as popular

restaurants) Taxis and other drivers will be unable to find locations just through the use of an address.

They will either need to be shown where the villa is, have access to a detailed map, or be in touch

with the villa before and be able to follow detailed verbal instructions delivered in the Balinese or

Indonesian languages.

We strongly recommend the use of cars with drivers for clients staying at villas.

The Private Company and Private Villas and Houses requires that your clients book transportation at the same time as they book the villa through you (the Agent) The Private Company and Private Villas and Houses can provide competitive private transfer rates for your clients.

 

Force Majeure

  • Neither party shall be liable to the other for any failure to perform any obligations under this

Agreement due to causes which are beyond their reasonable control and of a nature which

neither has the power or authority to remedy, including without limitation, acts of God, acts of

civil or military disturbances, fires, floods, epidemics, wars, riots and acts of terrorism.

In the event of such an occurrence, the party claiming relief thereon shall give prompt written

notice thereof to the other party and any time for performance of an obligation shall be

extended by time equal to the length of delay attributable to such occurrence.

  • Bookings affected by acts of war, terrorism or natural disaster have to be dealt with on a case by case basis. Assuming not eligible for a refund under normal cancellation terms, it is Private Companies and Private Villa and houses policy (with owner approval) to provide guests who have been affected by these events with a postponement of their booking (a credit) good for a period of one year, especially as the unique nature of our inventory results in owners turning away other requests for stays once a booking has been confirmed…Enforcement of this provision will be done on a case by case basis with consideration of the wishes of the villa owner and the guest.

 

Limit of Liability


To the maximum extent permitted by law, The Private Company and Private Villas and Houses excludes all liability for any loss or damage whatsoever including but not limited to physical and psychological injury, and loss or damage to property of whatever nature, wether in contract,tort or otherwise, for the acts, omissions or defaults, wether negligent or otherwise of third party providers we have no control of that may arise in any way in connection with the offer or supply of goods or services through The Private Company and Private Villas and Houses or any third parties, or in connection with the supply of such goods or services.

AGENCY

The Private Company puts together holiday packages but itself is not a transport, tour, event or accommodation provider: it acts only as an agent for those service providers it is therefore important for you to obltain and read the service providers terms and conditions applicable to the products in your package. Also, make sure you are aware of any exclusions or limitations of liability in respect to death, personal injury, delay and loss of luggage. The Private Company has no responsibility for the products and services provided by these service providers nor does it give any warranty or representation regarding the standard of those product and services. All bookings are made subject to the terms and conditions and limitations of liability imposed by those service providers. Your legal recourse is against the specific provider and not The Private Company. If for any reason any travel service provider is unable to provide the services for which you have contracted, your remedy lies against the provider and not with The Private Company.


Destination Passenger enquiries


The Private Company and Private Villas and houses makes no representation as to the safety, conditions or other issues that may exist at any destination. You should obtain travel advice from your countries own government including in Australia the department of Foreign affairs and trade. (www.smartraveller.gov.au)


Travel Insurance

It is strongly recommended at the time of booking to consider purchasing a travel insurance policy of your choice.


Health and Immigration

The passenger and their agent are responsible for all visa, passport, immigration, quarantine, customs, health and other requirements of the countries visited or transited. The Private Company and Private Villas and Houses is not responsible for the failure of the passenger to comply with these requirements.
